Determining the deadline for presentation of goods on the occasion of the release of goods for transit procedure

The provisions of Article 123 of the Customs Law prescribe the accountability of principals for presentation of goods to the declared office of destination in unaltered condition, within a prescribed deadline while adhering to measures determined by customs authorities to ensure there is no change in the goods identity.

Moreover, Article 404, paragraph 3 of the Regulation on Customs-Approved Treatment of goods additionally regulates the determination of the deadline within which the goods must be presented to the declared office of destination, taking into account transit direction, effective traffic or other regulations which were delivered by the principal.

Taking into account the aforementioned, it is necessary that the customs officers  at the customs office of departure in a national transit procedure determine the deadline for presentation of goods of 5 days.

Apart from this, we remind you that the procedure of deadline determination in the case of common transit procedure has been explained in more detail by the Customs Administration Act number 148-04-030-14-15/2/2016 from 18.2.2016. Having in mind the number of countries included in the common transit procedure, it is recommended that the presentation of goods deadline should not be shorter than 7 days for road traffic, that is 14 days for river and rail traffic. On the other hand, the deadline should not be longer than 14 days for road traffic and 28 days for river and rail traffic.

In this respect, the Customs Administration Act The Explanation of the computerized transit procedure number 148-04-030-13-1/2015 from 23.01.2015 is changed in part II, Procedures at the customs office of departure in item 9) Deadline Determination, and the Customs Administration Act number 148-05-030-01-105/2018 from 13.03.2018, so that the deadline for the presentation of goods to the declared office of destination in a national transit procedure is set to 5 days.

This deadline for the presentation of goods shall be applied as of 17.12.2018.
